Abstract

The activities of the Prosecutor at stage of criminal case initiation is carried out in two areas: criminal prosecution and supervision over the procedural activities of bodies of preliminary investigation and inquiry. Considering the Prosecutor as the subject of criminal prosecution, we must conclude that the Prosecutor today is deprived of such essential powers as the power to make, to verify the crime and to take a procedural decision on initiation of criminal case or on refusal in initiation of legal proceedings. It appears necessary to restore these procedural powers of the Prosecutor as the subject of criminal prosecution. Available now at the Prosecutor the authority to make a reasoned decision about the direction of relevant materials to an investigative body or the body of inquiry for the decision of a question
