On the order of prosecution of separate categories of persons in criminal cases of private

Abstract

The article examines the problem of the order of prosecution of certain categories of persons in criminal cases of private prosecution. Attention is drawn to the fact that in domestic legislation, there is no unequivocal answer to the question in what order, privately or publicly, these persons should be prosecuted in the event that they commit acts subject to private prosecution. Based on the study of the norms of the criminal procedure legislation of the Republic of Belarus and the Russian Federation, the author proposes a solution to this debatable issue.
