Has the legislator achieved his goals after the introduction of the institute of inquiry in an abbreviated form?

Abstract

Federal Law No. 23-FZ of 03/04/2013 introduced Chapter 32.1 of the Code of Criminal Procedure of the Russian Federation "Inquiry in an abbreviated form" into the Criminal Procedure Code of the Russian Federation. In the explanatory note to this bill, the legislator formulated three goals that he seeks to achieve by introducing this new form of preliminary investigation and a new form of consideration of a criminal case in court in a special manner: 1) saving procedural funds; 2) shortening the time of investigation and consideration of the case in court; 3) the expansion of dispositive principles in the exercise by suspects (accused) of the right to protection, and by victims of the right to access to justice. Having analyzed the materials of 70 criminal cases, which were investigated in an abbreviated form, and which were considered by the courts of the Vladimir region in the period from 2016 to 2021, the author answers the question whether the legislator has achieved the goals that he set for this new procedural institution.
