The article examines the legal nature and essence of the institution of establishing paternity in the family law of the Russian Federation. The author analyzes the theoretical foundations of this institute, its historical development and current state. Based on the conducted research, proposals have been formulated to improve legislation in this area, taking into account the balance of interests of the child, the mother and the prospective father.
