Preliminary Review of Draft Regulatory Legal Acts in Foreign Countries: Legislation and Judicial Practice

In this paper, the author examines the legislation of such states as Germany, the Republic of South Africa and Canada on conducting legal expertise in relation to draft regulatory legal acts. The author pays special attention to the practice of individual federal and devolved states on preliminary judicial or political control over draft laws and higher legislative acts of subnational entities. The author provides the provisions of the legislation of these states justifying a particular model of preliminary control, as well as relevant materials of judicial practice. In the work, the author also points out that in the Russian Federation there is no right of federal authorities to conduct a preliminary analysis of the developed draft laws of the subjects of the Russian Federation.
