Abstract

Discussions about the adequacy of the existing legal guarantees and Bank secrecy did not stop until the present time. However, the relevance of this problem increased sharply in the power of the recently changed circumstances of its legal regulation. The purpose of this article is to analyze the legal grounds for the provision of information, representing banking secrecy. Implementation of the tasks was achieved through systemic analysis, comparative legal, analytical, formal and logical approach. The author makes emphasis on the fact that banking secrecy being one of the most important institutions of civil and banking legislation, despite the seemingly obvious necessity of its legal protection, has increasingly become subject to various, including illegal encroachments by unauthorized bodies and officials.
