Abstract

code of criminal procedure in part 1 of article 37 introduced the concept of the prosecutors "supervision over the procedural activities of inquiry and preliminary investigation bodies". Current Federal law "On the procuracy of the Russian Federation" in articles 1 and 29 still operates with the concept of "supervision over the execution of laws by bodies of inquiry and preliminary investigation", the rest of the old RSFSR code of criminal procedure of 1960 (Chapter 18). In connection with the recent change in criminal procedure legislation, it seems necessary to highlight some key points related to the concept of prosecutorial supervision over the legality of the procedural activity of bodies of inquiry and preliminary investigation that must receive a legal basis in the new edition of the Federal law "On the procuracy of the Russian Federation".
