The second stage of the procedural activity in the production of inquiry in an abbreviated form

Abstract

Federal Law No. 23-FZ of 03/04/2013 introduced Chapter 32.1 of the Code of Criminal Procedure of the Russian Federation "Inquiry in abbreviated form" into the Criminal Procedure Code of the Russian Federation. Having analyzed the materials of 70 criminal cases on which an inquiry was conducted in an abbreviated form, and which were considered by the courts of the Vladimir region in the period from 2016 to 2021, the author describes the main forms of procedural activity during the inquiry in an abbreviated form. The author identifies five forms (stages, periods) of procedural activity in the conduct of an inquiry in an abbreviated form. The second stage of procedural activity in conducting an inquiry in an abbreviated form is the stage of conducting an inquiry in a general manner, which begins from the moment a criminal case is initiated against a particular person and ends with the issuance of a resolution on the satisfaction of the petition and on the conduct of an inquiry in an abbreviated form. The author describes what procedural actions are performed and what procedural decisions are made at this stage of the procedural activity.
