Abstract

Federal Law No. 23-FZ of 04.03.2013 introduced Chapter 32.1 of the Criminal Procedure Code of the Russian Federation "Pre-trial Inquiry in an Abridged Form". Article 226.1 of the Criminal Procedure Code of the Russian Federation states that the grounds for conducting an inquiry in an abbreviated form is a written petition of the suspect for conducting an inquiry in an abbreviated form. According to the provisions of Part 2 of Article 226.4 of the Criminal Procedure Code of the Russian Federation, a petition for conducting an inquiry in an abbreviated form is submitted to the investigator in writing and must be signed by the suspect and his defense attorney. The law links the filing of such a petition with the moment of the first interrogation of the suspect. The author analyzes the provisions of the law and judicial practice and makes proposals for improving the current legislation.
